LIABILITY WAIVER & RELEASE OF CLAIMS

BOSS CUSTOMS – Auto Detailing & Vehicle Protection Services
 British Columbia

This Liability Waiver and Release of Claims (“Agreement”) applies to all services performed by BOSS CUSTOMS (“Company”).

By signing below, the Client acknowledges and agrees to the following terms:

1. Acknowledgement of Service Risks

The Client understands that automotive detailing, paint protection film (PPF), ceramic coating, vinyl wrap installation, polishing, and cleaning services involve mechanical and chemical processes performed on vehicle surfaces and materials.

While BOSS CUSTOMS exercises professional care, certain risks cannot be eliminated due to vehicle condition, age, prior repairs, or material failure.

2. Pre-Existing Damage Release

The Client acknowledges that the vehicle may contain pre-existing damage including but not limited to:

  • Scratches, chips, dents, or paint defects

  • Prior repainting or bodywork

  • Weak or deteriorating clear coat

  • Interior wear or fragile components

The Client agrees that BOSS CUSTOMS is not responsible for identifying, repairing, or compensating for pre-existing damage, whether visible before or discovered during service.

3. Paint & Surface Failure Disclaimer

The Client understands that:

  • BOSS CUSTOMS cannot verify factory paint integrity or previous repair quality.

  • Repainted or aftermarket panels carry increased risk of paint lifting or failure.

The Client releases BOSS CUSTOMS from liability for:

  • Paint lifting or peeling

  • Clear coat failure

  • Adhesion failure during installation or removal of film or vinyl

  • Damage caused by defective or previously repaired paint surfaces

4. Limitation of Responsibility for Fragile Components

Older vehicles or previously worn materials may fail during normal service procedures.

BOSS CUSTOMS shall not be responsible for failure of:

  • Aging trim or plastics

  • Weather stripping

  • Emblems or badges

  • Interior electronics or fragile upholstery

when failure occurs due to normal service processes.

5. No Guarantee Against Future Damage

The Client understands that protective services do not prevent:

  • Rock chips

  • Scratches

  • Environmental wear

  • Accidents or misuse

BOSS CUSTOMS does not guarantee protection against future physical damage.

6. Limitation of Liability

To the fullest extent permitted under the laws of British Columbia:

  • Any liability of BOSS CUSTOMS shall be limited strictly to the amount paid for the specific service performed.

  • BOSS CUSTOMS shall not be liable for indirect, incidental, consequential, or loss-of-use damages.

Claims for dissatisfaction must be presented prior to vehicle departure.

7. Waiver of Claims

The Client voluntarily releases and forever discharges BOSS CUSTOMS, its owners, employees, and contractors from any claims arising from:

  • Pre-existing vehicle conditions

  • Paint or material failure unrelated to workmanship

  • Normal risks associated with detailing or installation services

8. Payment & Refund Acknowledgement

The Client acknowledges that protection services are custom, labour-intensive installations.

Once services are completed:

  • Payments are final.

  • Services are non-refundable except where required by applicable law.

Reasonable corrective work may be offered at the discretion of BOSS CUSTOMS where workmanship issues are verified.

9. Agreement Acceptance

By signing below, the Client confirms they:

  • Have read and understood this Liability Waiver
  • Had opportunity to ask questions
  • Voluntarily accept the risks associated with services performed
